Arbitration Notice for a Loan App or Personal Loan: What It Means and What to Do

Updated: 4 days ago
Opening your inbox or WhatsApp to find an arbitration notice for a loan app or personal loan can be frightening. The language is formal, there are case numbers and section references, and the message often sounds like you are already in court. Many borrowers panic, ignore it, or pay the first person who calls. None of these is the best response. An arbitration notice is a real legal step that deserves attention, but it is also a stage where you still have rights, time to respond and room to settle. This guide explains, in plain English, what a loan arbitration notice means in India, how to check whether it is genuine, what happens if you ignore it and how to use it as a chance to reach a fair, written settlement.

What is an arbitration notice for a loan?
Most digital loan agreements, personal loan agreements and credit card terms include an arbitration clause. You probably accepted it with one tap when you took the loan. The clause says that if there is a dispute, for example unpaid dues, it will be decided by a private arbitrator instead of a regular civil court.
When you miss payments for some time, the lender (the bank or NBFC behind the loan app) can invoke this clause. Under the Arbitration and Conciliation Act, 1996, arbitration formally begins when you receive a request to refer the dispute to arbitration. That is the notice you are holding. It usually includes:
The name of the lender and your loan account number
The amount claimed, often including interest and charges
The name of the proposed or appointed arbitrator, or an online dispute resolution (ODR) platform
A deadline to reply, submit documents or attend a hearing, often by video call
Arbitration is a civil process. An arbitration notice is not a police case, an FIR or an arrest warrant. Anyone who calls you saying that police will come to your house because of an arbitration notice is using fear, not law.
Arbitration notice vs legal notice vs Lok Adalat notice
Borrowers often receive several kinds of documents and mix them up. Here is the simple difference:
Legal notice: a letter from the lender or its advocate demanding payment. It is a warning, not a case. Read our guide on handling a legal notice from a loan app.
Lok Adalat notice: an invitation to settle before a Lok Adalat, a voluntary settlement forum. Nothing is decided against you if you do not agree. See what a Lok Adalat notice means.
Arbitration notice: the start of an actual dispute resolution process. If it goes ahead without you, the arbitrator can pass an award, which can later be enforced.
That last point is why an arbitration notice deserves more attention than a routine demand letter.
Step 1: Check whether the arbitration notice is genuine
Fake notices are common. Some illegal loan apps send documents with court logos and frightening language to rush people into paying. Before you do anything else, check these points calmly:
Does the lender name match your loan? The notice should name the regulated bank or NBFC that actually gave you the loan, not just the app's brand name. You can usually find the lender's name in your loan agreement or Key Facts Statement (KFS).
Is your loan account number correct? Compare it with your loan app, SMS or email records.
Is there a named arbitrator or a recognised ODR platform? A genuine notice identifies who will decide the dispute and how to contact them.
Does the amount roughly match your records? It may include interest and charges, but it should be traceable to your loan.
Where does it ask you to pay? A genuine process does not ask you to pay a personal UPI ID or an individual's bank account to "cancel the case".
If the lender is unknown, the app is not linked to any regulated entity, or the notice asks for urgent payment to a personal account, treat it as suspicious. You can check whether an app is linked to a regulated lender using our guide on how to check if a loan app is RBI approved.

Step 2: Do not ignore a genuine notice
Ignoring a genuine arbitration notice is usually the worst option. If you do not reply or attend, the arbitrator can proceed and pass an award based only on the lender's side. Under Section 36 of the Act, once the time to challenge an award has passed, the lender can apply to a civil court to enforce it in the same way as a court decree. Enforcement can involve steps such as attachment of bank accounts or property, ordered by the court.
Responding does not mean you are admitting everything the lender says. It means your side, your documents and your payment history are on record.
Step 3: Collect your documents
Before you reply, gather everything that shows what you actually borrowed and paid:
Loan agreement, sanction letter and Key Facts Statement (KFS)
Screenshots of the loan amount actually credited to your bank account
Repayment proofs: UPI references, bank statements, e-NACH debits
Any written promises of extension, waiver or settlement from the lender
Evidence of harassment, such as abusive messages, calls at odd hours or threats to contacts
These documents help you check the claimed amount. It is common to find processing fees, penal charges or interest that you did not clearly understand at the time of borrowing.
Step 4: Reply in writing and raise your concerns
Send a short, polite written reply to the arbitrator or platform within the deadline, and keep a copy. In it you can:
Confirm or dispute the amount claimed, with your reasons
Ask for a full statement of account showing principal, interest and charges
State that you are willing to discuss a settlement or a payment plan
Ask for the hearing to be conducted online if attending in person is difficult
Questions about the arbitrator's independence
Indian courts have taken a strong view on fairness in appointing arbitrators. In Perkins Eastman v HSCC (2019), the Supreme Court held that a party with an interest in the outcome cannot unilaterally appoint a sole arbitrator. In November 2024, a five-judge bench of the Supreme Court in the CORE case held that equal treatment of parties applies at every stage, including how the tribunal is formed, and that unilateral appointment clauses raise doubts about independence. How these rulings apply to your specific loan depends on the facts, so if the lender alone picked the arbitrator, this is worth raising in writing and discussing with a lawyer.
Step 5: If an award has already been passed
Sometimes borrowers only learn about the arbitration after the award is made. The law requires a signed copy of the award to be delivered to each party. Under Section 34(3), an application to set aside an award must be made within three months of receiving it. The court can allow a further 30 days if you show sufficient cause, but not beyond that. Grounds for setting aside are limited, so if you are in this situation, speak to a lawyer quickly. Payday Rescue is not a law firm, but we can help you organise your papers and understand your settlement options alongside legal advice.
Step 6: Use the notice as a chance to settle
Here is the part many borrowers miss: you can settle at any point, even during arbitration. Section 30 of the Act allows parties to settle, and the arbitrator can record the settlement as an award on agreed terms. Lenders often prefer a realistic settlement to a long process.
A sensible settlement approach looks like this:
Know your real numbers. Work out what you can pay as a lump sum or in instalments without borrowing from another app.
Make a written proposal. Explain your situation honestly, such as job loss, medical expenses or salary delay. Our settlement letter format can help.
Get the offer in writing on the lender's letterhead or official email before you pay anything.
Pay only to the lender's official account and keep every receipt.
Ask for a closure letter or No Dues Certificate, and confirm the arbitration is withdrawn or closed.
An illustrative example
This is an illustrative example, not a real client story. Imagine a salaried borrower in Pune who took three app loans during a salary delay and fell behind on one of them. Months later, an arbitration notice arrives by email. Instead of ignoring it, she checks the lender name against her KFS, confirms it is genuine, collects her repayment proofs and replies within the deadline, disputing some charges and proposing a structured settlement. The lender responds with a revised figure, which she accepts only after receiving it in writing. The process takes effort, but she stays in control.
How a settlement affects your CIBIL score
Settling a loan, whether through arbitration or directly, usually means paying less than the full outstanding amount. Lenders report this to credit bureaus as "settled" rather than "closed". A settled status affects your CIBIL score and can make new loans harder to get for some time. That does not mean settlement is wrong for you. When the alternative is mounting penalties and stress, a settlement can be a practical reset. Read more in our guide on CIBIL after default and settlement.
What about harassment while arbitration is going on?
An arbitration notice does not give anyone the right to harass you. RBI's fair-practice guidance says recovery agents should not call before 8 am or after 7 pm and must not use abusive language, threats or public humiliation. If you face threats or messages to your contacts, report it to the national cybercrime helpline 1930 or at cybercrime.gov.in, and keep screenshots.
The Reserve Bank – Integrated Ombudsman Scheme, 2026, which took effect on 1 July 2026, is the route for complaints against regulated lenders after you first complain to the lender. Note that the Ombudsman generally will not take up the same grievance if it is already pending before a court or an arbitrator, so think carefully about which issue you are raising where.

Frequently asked questions
Can I be arrested because of a loan arbitration notice?
An arbitration notice starts a civil process to recover money. It is not a criminal case, FIR or arrest warrant. Be cautious of anyone who uses arrest threats to demand immediate payment.
What happens if I ignore an arbitration notice?
The arbitrator can proceed without you and pass an award based on the lender's claim. Once the time to challenge it has passed, the lender can ask a civil court to enforce the award like a decree. Responding keeps your side on record.
Can I still settle after receiving an arbitration notice?
Yes. You can settle at any stage, and the arbitrator can record the settlement as an award on agreed terms. Always get the settlement in writing before paying, and ask for a closure letter afterwards.
How long do I have to challenge an arbitration award?
An application to set aside an award must be made within three months of receiving it, with a possible further 30 days if the court accepts your reason for the delay. Speak to a lawyer promptly if you are in this situation.
