Your Rights Against Recovery Agents in India (RBI Guidelines)

Many borrowers in India face recovery agent harassment, home visits and repeated calls that feel scary and confusing. This page explains, in simple language, what RBI-related rules say about recovery agent behaviour and what you can do if someone crosses the line.

Key rules for recovery agents

Calling Hours

Recovery agents should call or visit you only between 8:00 AM and 7:00 PM. If someone calls very early in the morning or late at night, you can remind them of this rule and ask them to call during the day instead.

No Harassment

RBI guidelines for recovery agents say they must not use threats, abuse, bad language or public humiliation. Shouting, insulting you, or threatening to shame you in front of neighbours is not acceptable behaviour.

Family Privacy

Agents should not call your family, friends or colleagues just to shame or pressure you. If a home visit recovery agent or caller is trying to involve others to embarrass you, you can tell them this is against fair practice rules.

Identification

A genuine recovery agent must clearly tell you their name, the company they work for and which lender they represent. If they refuse to identify themselves, you can treat the call as suspicious and avoid sharing personal details.

Lender Responsibility

Your bank, NBFC or lender is responsible for the behaviour of its agents. If you face recovery agent harassment, you can complain directly to the lender and expect them to take it seriously.

What to note down during a call or visit

Keep this simple checklist handy whenever you receive a call or visit from a recovery agent. Writing things down will help you if you need to complain later.

Date and accurate time

Caller’s phone number

Full name of the person and the lender they say they represent

What was specifically said, especially any threats or abusive words

Screenshots of chats or call logs

Call recordings if available and allowed in your state

How to complain if an agent crosses the line

01

Contact the lender first

Start by filing a formal complaint with your lender’s customer care and grievance officer. Share your loan details, dates, times, phone numbers and what the agent said or did. Keep a copy or screenshot of your complaint for your records.

02

RBI Integrated Ombudsman

If you do not get a reply within 30 days, or the reply does not solve the problem, you can complain to the RBI Integrated Ombudsman through the CMS portal at cms.rbi.org.in. Attach your earlier complaint and any proof you have collected.

03

Police and cybercrime help

If you face threats, blackmail, misuse of your photos or serious safety concerns, treat it as urgent. You can call the national helpline 1930, report online at cybercrime.gov.in, or go to your nearest police station with your evidence.
