Debt collection can feel frightening when calls become rude, repeated, or public. The RBI guidelines for recovery agents make one thing clear, lenders and their agents cannot use harassment to recover money. Borrowers in India have rights, including limits on call timings, protection from threats, and a proper complaint route when an agent crosses the line.

This guide explains the current loan recovery rules in India, what changes under the 2026 recovery conduct directions for commercial banks, what applies to digital lending and loan apps, and what to do if recovery agent harassment is happening now.

This article is for general information only. For advice on a specific debt or legal issue, speak to a qualified professional.

RBI guidelines for recovery agents and what they already protect

RBI has repeatedly told regulated lenders that recovery must be fair, respectful, and lawful. A borrower may owe money, but that does not give a lender or agent the right to threaten, insult, shame, or harass them.

The key principle is simple: recovery should never violate a borrower’s dignity or privacy.

Recovery agent call timings are limited

Recovery calls and visits should happen only between 8 am and 7 pm. This is one of the most important borrower protections.

If an agent calls late at night, early in the morning, or keeps calling outside these hours, keep a record. Note the number, time, date, and what was said.

Calls at odd hours are not “normal recovery pressure”. They can form part of a written complaint to the lender.

Agents cannot use abuse, threats, or public shaming

Recovery agents cannot use:

  • Abusive or insulting language

  • Threats of violence

  • Threats of arrest without legal basis

  • Public shaming

  • Repeated intimidation

  • Humiliation at your home, workplace, or neighbourhood

A recovery agent is allowed to ask for payment. They are not allowed to scare you into paying by using illegal or degrading methods.

If an agent says they will “send police”, “come with goons”, “tell your employer”, or “make your photo viral”, treat it seriously. Save proof and complain in writing.

Relatives, friends, and colleagues cannot be contacted to humiliate you

Agents should not contact your relatives, friends, neighbours, or colleagues to shame you or pressure you.

This is especially important in payday loan and instant loan app cases, where borrowers often complain that their contact list is misused. Even if you gave certain permissions during app installation, recovery cannot become harassment.

A lender or agent may have limited reasons to contact a reference, but they cannot disclose your debt to others or use third parties to embarrass you.

The lender is responsible for agent conduct

A common excuse is, “The bank gave your account to an agency, speak to them.” That does not remove responsibility.

The lender remains responsible for the conduct of its recovery agents. If an agent misbehaves, complain to the lender in writing. Do not limit your complaint only to the person who called you.

Mention that the agent is acting on behalf of the lender and ask the lender to stop the misconduct.

Allowed vs Not allowed for recovery agents

Not allowed for recovery agents

Calling late at night or before 8 am

Refusing to identify themselves

Asking for payment or discussing settlement options

Threatening violence, arrest, or public humiliation

Contacting relatives, friends, or colleagues to shame the borrower

Carrying ID and authorisation, where required

What RBI rules for loan recovery 2026 add for commercial banks

The RBI rules for loan recovery 2026 add more transparency for recovery conduct by commercial banks. These changes are expected to apply from 1 January 2027.

The aim is to make it harder for unknown agents to appear at a borrower’s home without proper notice or authority.

Banks must publish their list of recovery agencies

Commercial banks will have to publish the list of recovery agencies engaged by them.

This helps borrowers check whether the person contacting them is actually connected to the bank. It also helps reduce the risk of fake recovery agents using fear to collect money.

If someone claims to represent a bank, you can ask:

  • Which agency do you work for?

  • Is your agency listed by the bank?

  • What is your employee ID?

  • Can you show written authorisation?

Borrowers must be informed before the first home visit

Before the first home visit, the borrower must be informed.

This matters because surprise visits are often used to create fear. Prior information gives the borrower a chance to verify the agent, ask for details, and avoid dealing with unknown people at the door.

If an agent arrives without prior information, stay calm. Do not get into an argument. Ask for identification and authorisation. If they refuse, do not continue the discussion.

Agents must carry ID and an authorisation letter

Recovery agents should carry:

  • Their identity card

  • An authorisation letter from the bank or lender

  • Details that connect them to the specific recovery assignment

Do not rely only on a phone screen or verbal claim. Ask to see proper identification. If you feel unsafe, speak through the door, call the lender’s customer care, or request communication in writing.

Grievance officer details must appear in recovery communication

Recovery communication should include grievance officer details.

This gives borrowers a clear route to complain when recovery conduct becomes improper. A borrower should not have to search endlessly for where to report abuse.

If the message or notice does not mention grievance details, write to the lender and ask for the grievance officer’s name, email ID, and complaint reference number.

What loan apps must follow under RBI’s Digital Lending Directions 2025

Instant loan apps and digital lenders have become a major source of stress for borrowers. Many people take a small loan for a short gap and then face high pressure, repeated calls, and threats when they fall behind.

RBI’s Digital Lending Directions 2025 address recovery conduct in the digital lending space.

Recovery agent details must be shared before contact

For digital lending, recovery agent details should be shared with the borrower before the agent contacts them.

This means you should know who is going to contact you for recovery. A random caller cannot simply claim authority and start threatening you.

If a loan app recovery agent calls without details being shared first, ask for written confirmation from the lender or lending service provider.

Loan apps must have a nodal grievance officer

Digital lending arrangements must provide a proper complaint route, including a nodal grievance officer.

If an app’s recovery agent abuses you, threatens you, or misuses your data, complain to the lender or platform in writing. Ask for the complaint to be acknowledged.

Keep screenshots of:

  • App name and lender name

  • Loan account details

  • Recovery messages

  • Call logs

  • Threats

  • Any contact with your family, friends, or workplace

This is especially important where threats involve morphed photos, fake legal notices, or messages sent to your contacts.

What to do when a recovery agent breaks the rules

When an agent breaks the rules, the best response is calm documentation. Do not threaten back. Do not delete messages. Your aim is to create a clear record.

1. Record the call where lawful and keep call logs

If you receive abusive or threatening calls, record the conversation where lawful and possible. At the very least, save call logs.

Maintain a simple note with:

  • Date and time

  • Phone number

  • Name of caller, if given

  • Agency name, if given

  • What was said

  • Whether the call was outside allowed recovery agent call timings

Screenshots and recordings can support your complaint.

2. Ask for ID and written authorisation

If someone visits your home, ask for ID and authorisation.

You can say:

“Please show your identity card and authorisation letter. I will verify this with the lender before discussing anything.”

If they refuse, do not continue the discussion. If they threaten you, record details and complain.

3. Complain to the lender in writing

Send a written complaint to the lender’s customer care or grievance officer. Email is useful because it creates a timestamp.

Include:

  • Your loan account number or registered mobile number

  • The caller’s number and name, if known

  • Date and time of calls or visits

  • Exact words used, if possible

  • Screenshots, recordings, or call logs

  • What action you want, such as stopping abusive calls and sharing authorised recovery details

Ask for a complaint reference number.

4. Wait 30 days, then escalate to the RBI Ombudsman if needed

If the lender does not reply within 30 days, or you are not satisfied with the response, you can escalate the complaint to the RBI Ombudsman through the Complaint Management System at cms.rbi.org.in.

Keep your documents ready before filing:

  • Complaint sent to the lender

  • Complaint reference number, if any

  • Lender’s reply, if received

  • Evidence of harassment

  • Loan details

The RBI Ombudsman route is meant for complaints against RBI-regulated entities. If you are unsure who the regulated lender is behind a loan app, check the loan documents, key fact statement, app disclosures, or lender name shown in the agreement.

5. Report cyber threats, morphed photos, or blackmail immediately

If threats involve morphed photos, obscene content, fake posts, contact list misuse, or blackmail, treat it as a cyber safety issue.

You can:

  • Call 1930

  • Visit cybercrime.gov.in

  • Save screenshots and phone numbers

  • Do not pay only because someone is blackmailing you

  • Do not delete the app until you have saved key proof, if it is safe to keep it

If there is immediate danger, contact local police.

How Payday Rescue helps with payday loan settlement and loan settlement

Payday Rescue is a Bangalore-based loan settlement and debt relief service that helps people dealing with payday loans, instant loan apps, and stressful recovery calls.

When debt becomes unmanageable, many borrowers do not know what to say to lenders. They may panic, take another loan, or agree to payment terms they cannot afford. That can make the cycle worse.

Payday Rescue helps by:

  • Reviewing your loan situation

  • Helping you understand what you owe

  • Communicating with lenders or recovery teams where appropriate

  • Working towards a practical settlement discussion

  • Helping you organise documents and communication

  • Guiding you on how to respond to harassment

A settlement means negotiating with the lender for a possible reduced or structured payment. The outcome depends on the lender, loan type, account status, and documents. No responsible service can guarantee that calls will stop immediately or that every lender will accept the same terms.

But a clear settlement approach can reduce panic. It also moves the conversation from pressure and fear to documented negotiation.

Know your rights before fear takes over

The RBI guidelines for recovery agents do not cancel a valid loan. They also do not mean a borrower can ignore repayment. But they do protect borrowers from abuse, threats, humiliation, and unlawful pressure.

Remember the basics:

  • Calls and visits should be between 8 am and 7 pm.

  • Agents cannot abuse, threaten, or publicly shame you.

  • They cannot contact others to humiliate you.

  • The lender is responsible for agent conduct.

  • Commercial banks must follow stronger transparency rules from 1 January 2027.

  • Loan apps must share recovery agent details before contact and provide grievance support.

  • Serious threats, blackmail, or morphed photos should be reported through 1930 or cybercrime.gov.in.
