Loan App Asking for Your Contacts or Photos? Your Data Privacy Rights Explained

Updated: 4 days ago
When you install an instant loan app, it often asks for a long list of permissions before showing you a single loan offer. Contacts, photos, files, location, call logs. Many borrowers tap "Allow" without thinking, because they need money fast. Later, when a repayment is missed, they discover why some apps wanted that loan app contacts access: to message friends, family and colleagues. This guide explains what a legitimate loan app is allowed to access on your phone under RBI rules, what it is not, how to take back control of your data, and what to do if your data is already being misused.

Why loan apps ask for so many permissions
Some permission requests are reasonable. A lender has to verify who you are, so it may need your camera for a selfie or a photo of your documents, and your location to confirm where you are when you apply. Other requests have nothing to do with lending. Illegal apps have historically harvested contact lists and photo galleries so they could pressure borrowers by shaming them in front of the people they know.
The RBI noticed this pattern and has been tightening the rules since its first digital lending guidelines in 2022. Those rules were consolidated in the Reserve Bank of India (Digital Lending) Directions, 2025, issued in May 2025, which apply to banks, NBFCs and other regulated lenders and the apps they work with.
What a legitimate loan app may access
Under RBI's digital lending framework, data collection must be need-based, with your prior and explicit consent, and with an audit trail. In practice that means:
One-time access to camera, microphone and location is allowed only for onboarding or KYC purposes, and only with your explicit consent.
Consent must be specific. You should be able to agree or refuse particular uses of your data, and refuse sharing with third parties.
You can ask for deletion. The framework gives borrowers the option to revoke consent already granted and to have data collected by the app deleted, subject to what the lender must keep by law.
Data must be stored in India. Personal data collected by digital lenders must be stored on servers located in India.
What a legitimate loan app should not access
RBI's guidance has directed digital lending apps to avoid accessing mobile phone resources such as files and media, contact lists, call logs and telephony functions. In plain terms, a lawful loan app linked to a regulated lender has no good reason to read your contact list or scroll through your gallery.
If an app refuses to work unless you hand over your contacts or photos, treat it as a serious warning sign. Very often, that app is not linked to any RBI-regulated lender at all. You can check this by looking up the app in the RBI's Digital Lending Apps directory on the RBI website, which was launched in July 2025, and by reading our checklist to verify whether a loan app is RBI approved.
The bigger picture: India's data protection law
Alongside RBI's rules, India now has a general data protection law, the Digital Personal Data Protection Act, 2023. Its implementing rules were notified in November 2025, with obligations being phased in over the following months. Broadly, the law requires organisations to collect personal data only for a clear purpose with valid consent, and gives individuals rights to information, correction and erasure. As these provisions come into force, they add another layer of protection on top of RBI's lending-specific rules.

How to take back control of your phone data today
You do not need technical skills to reduce what an app can see. Work through this checklist:
Review app permissions. On Android, open Settings, then Apps, choose the loan app and open Permissions. On iPhone, open Settings and scroll to the app. Turn off Contacts, Photos/Files, Call logs, SMS and Location unless there is a clear reason.
Remove permissions you never meant to give. Most phones now let you allow access "only while using the app" or "ask every time". Use these options.
Do not uninstall in a panic if you still owe money. First download or screenshot your loan agreement, Key Fact Statement, repayment schedule and payment receipts. You will need them for any complaint or settlement.
Write to the lender to withdraw consent. Email the grievance officer named in your loan documents, asking them to stop using any contact or media data and to delete data that is not required by law. Keep a copy.
Warn your close contacts. A short message such as "If anyone messages you about a loan of mine, please ignore it and send me a screenshot" protects them and gives you evidence.
Secure your accounts. Change passwords and turn on two-factor authentication for your email, UPI and social media if you shared OTPs or documents with a suspicious app.
If an app is already misusing your contacts or photos
When a loan app messages your contacts, posts about you, or threatens to share edited photos, the priority is safety and evidence, not repayment to the app.
Do not delete messages. Take screenshots showing the number, date and time.
Report the incident. Call the National Cybercrime Helpline 1930 or file a complaint at cybercrime.gov.in. You can also visit your local police station or cyber cell.
Report the app. If the app is not linked to a regulated lender, you can report it on the RBI's Sachet portal (sachet.rbi.org.in).
Complain to the lender and then the RBI. If the app is linked to a regulated lender, complain to its grievance officer in writing. If the lender does not resolve the complaint within 30 days, or rejects it, you can escalate to the RBI Ombudsman through cms.rbi.org.in.

Questions to ask before you install any loan app
Prevention is far easier than cleaning up after a data leak. Before you borrow through any app, ask:
Which bank or NBFC is the actual lender, and is that name shown clearly in the app and the loan agreement?
Does the app appear in the RBI's Digital Lending Apps directory?
Does it show a Key Fact Statement with the Annual Percentage Rate (APR) and all charges before you accept?
Is it asking for contacts, files or call logs? If yes, walk away.
Is the privacy policy easy to find, and does it name a grievance officer?
An illustrative example
This is an illustrative example, not a real client story. Priya, a retail sales executive in Pune, borrowed ₹8,000 from an app that asked for access to her contacts at sign-up. When she was a week late, three colleagues received messages calling her a fraud. Priya kept screenshots, called 1930 to register a cyber complaint, switched off the app's permissions and checked the RBI directory, where the app was not listed. She then took advice on how to deal with the debt safely, separately from the harassment, rather than paying whatever the callers demanded.
How Payday Rescue helps
Payday Rescue is a Bengaluru-based debt resolution advisory helping borrowers across India deal with payday loans, instant loan apps, personal loans and credit card dues. We are not a law firm, and we do not lend. If your phone data is being misused or you fear it might be, we can help you:
Understand who your real lender is and whether the app is linked to a regulated entity.
Prepare clear, factual complaints to the lender, the RBI channels and cyber crime authorities.
Separate the harassment from the debt. Paying an illegal app under pressure rarely ends the threats. We help you work out what you genuinely owe and to whom.
Negotiate a repayment plan or settlement with regulated lenders where appropriate. Settlement can reduce what you pay, but it is reported to credit bureaus and affects your CIBIL score, so we explain the trade-offs first.
Your first consultation is free and confidential. We follow RBI fair-practice guidance in how we advise borrowers, we do not promise specific outcomes, and our fees are explained clearly before you enrol. To see how the full process works, read how Payday Rescue's settlement service works.
Frequently asked questions
Can a loan app legally access my contact list?
RBI's digital lending guidance directs lending apps to avoid accessing contact lists, call logs, files and media. Only one-time access to camera, microphone and location is allowed for onboarding or KYC, with your explicit consent. An app that insists on your contacts is a major red flag.
Can I withdraw consent after taking a loan?
Yes. RBI's framework gives borrowers the option to revoke consent and ask for their data to be deleted, though the lender may keep records it is required to retain by law. Make the request in writing to the lender's grievance officer and keep a copy.
If I revoke permissions, do I still have to repay the loan?
If the loan is from a regulated lender, yes. Revoking permissions protects your data; it does not cancel a genuine debt. If you cannot repay, speak to the lender or an adviser about a revised plan rather than ignoring it.
Will reporting an app affect my CIBIL score?
Reporting harassment or an illegal app does not by itself affect your CIBIL score. Your score is affected by how loans from regulated lenders are reported, including late payments and any settlement, which is reported as "settled" and does affect your score.
